Terms of Service

1. Agreement to Terms

By creating an account, visiting our website, or using the Stridesy application ("App," "Service," or "we"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all visitors, users, and others who access the Service, including free, paid, trial, beta, and early-access features.

These Terms incorporate our Privacy Policy and Disclaimer. If these Terms conflict with a separate written agreement signed by us, that written agreement controls for the subject matter it covers.

2. Who May Use This Service

Stridesy is intended for use by parents and legal guardians of children with developmental differences. You must be at least 18 years of age and the parent, legal guardian, or authorized caregiver of any child whose information you enter into the App. By using the Service, you represent and warrant that you have the legal authority to share the child's information and to consent to the terms described herein on behalf of that child.

This Service is not intended for direct use by minors. All accounts must be created and managed by an adult caregiver, and you are responsible for supervising any child-related activity, routine, reward, or real-world practice you choose to use.

3. Description of Service

Stridesy provides a parent-facing coaching and tracking tool designed to help caregivers support skill development in children with developmental differences. The Service may include intake questions, goal recommendations, structured activities, practice logs, routines, rewards, progress reports, Foundations features, browser speech tools, and educational guidance based on evidence-informed frameworks.

Stridesy is not a medical provider, licensed therapy platform, emergency service, or substitute for professional care. The Service does not provide diagnosis, treatment, crisis support, medical advice, legal advice, special education advice, or any regulated professional service. See our Disclaimer for full details.

Some features may use automated or AI-assisted tools to help organize responses, suggest goals, generate educational guidance, or support parent coaching workflows. AI-assisted output may be incomplete, inaccurate, or inappropriate for your situation. You are responsible for reviewing all output and deciding whether and how to use it.

The Service is not designed for emergencies or unsafe situations. If a child or another person may be in danger, contact emergency services, a qualified professional, or another appropriate support resource immediately.

4. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at legal@stridesy.app of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to maintain account security.

You may not share your account with others or use a single account to track children for multiple unrelated families without express written permission. We may limit registration, require invitation or access approval, suspend access, or refuse service where we reasonably believe doing so is necessary to protect users, children, the Service, or our business.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others. You agree not to:

  • Enter false or misleading information about yourself or any child
  • Enter information about a child unless you are legally authorized to do so
  • Upload government identifiers, insurance numbers, school records, medical records, or other unnecessary sensitive records unless we specifically request them
  • Use the Service to diagnose, treat, document medical necessity, make school placement decisions, submit insurance claims, or bill under any healthcare, education, or public benefit program
  • Use the Service as a substitute for professional judgment, safety planning, supervision, or emergency care
  • Attempt to reverse-engineer, scrape, copy, extract data from, or train a competing system using the Service
  • Upload or transmit viruses or any other malicious code
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Use the Service to harass, exploit, endanger, or violate the rights of another person
  • Use the Service in any way that could harm, disable, overburden, impair, or interfere with it

6. Data You Provide

You retain ownership of the information you enter into Stridesy, including information about your child. You represent and warrant that you have all rights, permissions, and authority needed to provide that information to us and to allow us to process it under these Terms and our Privacy Policy.

By using the Service, you grant Stridesy a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, adapt, de-identify, and otherwise use the information you provide as reasonably necessary to operate, maintain, secure, support, improve, and provide the Service; to work with our service providers; to comply with law; and as otherwise described in our Privacy Policy.

You also grant Stridesy the right to use de-identified, aggregated data derived from your usage for research, product improvement, analytics, publication, and business purposes. This data will not include your name, your child's name, email address, or other directly identifying information. See our Privacy Policy for full details, including how to opt out of de-identified research use.

7. Intellectual Property

The Service and its original content (excluding data you provide), features, and functionality are and will remain the exclusive property of Stridesy and its licensors. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

Activity content, goal templates, coaching frameworks, routines, rewards, reports, visuals, and educational materials available in the App are proprietary and may not be reproduced or distributed outside the Service.

If you submit ideas, suggestions, feedback, or requests, you grant us the right to use them without restriction or compensation, unless we separately agree otherwise in writing.

8. Subscription and Payments

Certain features of the Service may require a paid subscription, one-time purchase, or other paid plan. Current pricing, plan details, taxes, and any renewal terms will be disclosed at the point of purchase or upgrade. Payments may be processed by a third-party payment provider, and your payment method information may be handled by that provider under its own terms and privacy disclosures.

Automatic Renewal Disclosure (California Business & Professions Code § 17600-17606): If you purchase an automatically renewing subscription, it will automatically renew at the end of each billing period at the then-current subscription rate until you cancel. You will be charged to the payment method on file at the start of each renewal period. For annual subscriptions, we will provide renewal reminders where required by law.

How to cancel: You may cancel a subscription using the cancellation mechanism provided at purchase, through the payment processor or app marketplace if applicable, through Account settings when available, or by contacting us at legal@stridesy.app. Cancellation takes effect at the end of the current billing period; you will retain access through the date you have already paid for unless otherwise stated at purchase. We do not offer prorated refunds for partial billing periods, except where required by law.

Free trials: If a free trial is offered, we will disclose the trial length and the subscription price that will apply after the trial ends before you provide payment information. Your subscription will begin automatically at the end of the trial unless you cancel before the trial expires.

We may change prices, plans, features, or billing practices prospectively by providing notice where required. If a payment fails, we may suspend or limit paid features. Refund eligibility beyond the above is determined on a case-by-case basis and as required by law. Contact us at legal@stridesy.app with any billing concerns.

9. Rewards and Virtual Items

The Service may include coins, chests, collectibles, reward items, redemption requests, streaks, progress visuals, or similar motivational features. These features are tools for parent-managed encouragement only. They have no cash value, are not property, are not transferable, and may not be sold, exchanged, redeemed for money, or used outside the Service.

We may modify, rebalance, suspend, reset, or discontinue any rewards or virtual items at any time. You are solely responsible for choosing any real-world rewards, deciding whether they are safe and appropriate, and supervising their use.

10. Service Changes and Availability

We may add, remove, modify, suspend, discontinue, or limit any part of the Service at any time, including free, paid, beta, or early-access features. We do not guarantee that any feature, report, recommendation, symbol, image, routine, reward, integration, or item of content will remain available.

The Service may depend on third-party providers, browsers, devices, networks, hosting platforms, AI-assisted processing, content delivery providers, transactional email providers, and payment processors. We are not responsible for failures, outages, delays, or changes caused by those third parties or by your device, browser, internet connection, or settings.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

We do not warrant that any recommendation, activity, report, AI-assisted output, browser speech result, educational guidance, image, symbol, routine, or reward will be accurate, complete, appropriate, available, or suitable for your child or circumstances. We do not warrant that any results, outcomes, or developmental gains will be achieved through use of the App. Individual results will vary based on many factors outside our control.

Note for California residents: Some implied warranties cannot be disclaimed under California law. To the extent such warranties apply, they are limited in duration to the shortest period permitted by law.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Stridesy SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, SERVICE INTERRUPTION, SECURITY INCIDENTS OUTSIDE OUR REASONABLE CONTROL, OR HARM ARISING FROM YOUR RELIANCE ON THE SERVICE AS A SUBSTITUTE FOR PROFESSIONAL CARE, SAFETY SUPERVISION, OR EMERGENCY SUPPORT.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

Note for California residents: California Civil Code § 1668 provides that certain contractual provisions that exempt parties from liability for their own fraud, willful injury, or violation of law are void. Nothing in these Terms limits our liability for fraud, willful misconduct, or gross negligence to the extent prohibited by applicable California law.

13. Indemnification

You agree to indemnify and hold harmless Stridesy and its officers, directors, employees, contractors, service providers, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service, information you provide, your lack of authority to provide child information, real-world rewards or activities you choose, your professional or commercial use of the Service, your violation of these Terms, your violation of law, or your violation of any rights of a third party.

14. Termination

We may suspend, limit, or terminate your account or access to the Service at any time if we reasonably believe you have violated these Terms, created legal or security risk, misused the Service, failed to pay amounts owed, or otherwise acted in a way that may harm users, children, the Service, or our business. We may do so with or without notice where permitted by law.

You may delete individual child profiles in the App. To delete your full account or request deletion of associated personal information, contact us at legal@stridesy.app. Upon termination, your right to use the Service ceases immediately. We may retain records as described in our Privacy Policy, including limited records for legal, security, audit, billing, debugging, dispute, and de-identified aggregate purposes.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date and, where appropriate, by notifying you via email or in-app notice. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

16. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the state where Stridesy has its principal place of business or is incorporated, without regard to conflict of law principles, except where applicable consumer protection law requires otherwise.

Informal resolution: Before filing any claim, you agree to contact us at legal@stridesy.app and give us 30 days to resolve the issue informally.

Binding arbitration: If we cannot resolve a dispute informally, you and Stridesy agree to resolve it through binding individual arbitration administered by a recognized arbitration body under its then-current rules, rather than in court. You waive the right to a jury trial and to participate in a class action or class-wide arbitration. This arbitration clause does not apply to: (a) claims within the jurisdiction of small claims court; (b) intellectual property infringement claims; or (c) requests for injunctive or other equitable relief.

Note for California residents: California residents who wish to resolve a dispute may also contact the California Department of Consumer Affairs, Division of Consumer Services, at 1-800-952-5210 or at www.dca.ca.gov. Nothing in this Section limits your rights under California consumer protection statutes.

17. California Users: Additional Rights

California residents have additional rights under the California Consumer Privacy Act (CCPA), California Privacy Rights Act (CPRA), CalOPPA, and the California Automatic Renewal Law. See our Privacy Policy for a full description of your California privacy rights, including the right to know, delete, correct, opt out of sale, and limit use of sensitive personal information.

Under the California Automatic Renewal Law (Business & Professions Code § 17600-17606), companies that offer automatically renewing subscriptions are required to clearly disclose renewal terms before purchase, obtain affirmative consent, and provide a simple cancellation mechanism. If we offer automatically renewing subscriptions, we will provide those disclosures and cancellation controls as described in Section 8 and as required by law.
